1. Provider and scope

Wizards’ Club is provided by Brackets V.O.F., Klaas van Reeuwijkstraat 9, 2132 ZP Hoofddorp, the Netherlands, registered with the Dutch Chamber of Commerce under number 70294194. Email for questions, complaints and cancellation: raymond@dockyard.app. “We” means Brackets V.O.F.; “you” means the user creating an account.

These terms apply to the Wizards’ Club account service. You can read and download them before registration. The agreement starts when you actively accept these terms and your account is created. Before submitting the registration form, you can still check and correct your input. We keep the accepted version, language and time of acceptance as evidence of the agreement; the accepted text remains available at its own web address. You can also use the counter without an account; this does not require registration or acceptance through an account.

2. What the service does

Wizards’ Club helps you count life and record games, decks, game nights, contacts, groups and statistics. It is not an official tournament organiser and does not determine official game rules, rankings or prizes. You remain responsible for agreements at the table and checking the results you enter.

The counter works without an account and can work offline after loading. Registration and synchronisation require a connection. Not every feature using server data is available offline. The current features, explanations in the app and website help describe what you can expect.

3. Your account

Provide a reachable email address and keep your login details confidential. Do not impersonate someone else. Notify us as soon as possible if you suspect unauthorised access. You are not automatically liable for every action by someone else; the statutory rules apply.

If you are a minor, obtain permission from a parent or guardian where the law requires this for this agreement. A parent or guardian can contact us about this.

4. Costs and possible paid features

Creating an account is free and does not require a purchase. The counter, individual games, your own history and game-night standings are free.

Any paid Club subscription requires a separate, express order. Before you order, we inform you about the features, total price including applicable taxes, billing period, duration, renewal, cancellation and statutory withdrawal period. These terms do not authorise us to convert a free account automatically or collect payments. An announced feature or indicative price is not an order.

5. Responsible use

Use the service lawfully and respect other players. Do not add unlawful, threatening or discriminatory content, personal data unnecessary for playing, or material for which you lack the required rights.

Do not attempt to access other accounts or data without authorisation, bypass security, deliberately disrupt the service or impose an excessive load. Statutory rights, including permitted research and interoperability, remain intact. Report vulnerabilities privately to our email address so we can investigate.

6. Your content and shared history

You retain your rights to content you add. You grant us only the non-exclusive permission needed to store, process and display it to the relevant users through the service. This does not transfer ownership or permit advertising use of your content.

Names, participants, results and other shared game data may be visible to other involved players and hosts. Inform people before entering their data and use a guest name where appropriate. Share linking and joining codes only with people who should have access. Linking a contact may also reveal earlier history.

Results are shared facts: editing or closing your account does not automatically remove all shared results. Statutory privacy rights continue to apply. We assess erasure or anonymisation requests under the law and the rights of those involved.

7. Storage, synchronisation and maintenance

Data may initially be stored on your device and synchronised with the server later. Clearing browser data, losing a device or removing the app can result in loss of data that has not yet synchronised. Check synchronisation status before clearing local storage if you have connection problems.

We provide the service with the care you may reasonably expect, including appropriate security, maintenance and correction of faults. We do not promise uninterrupted availability or error-free results. Statutory duties regarding conformity, security updates and remedies remain fully applicable. Where reasonably possible, we announce planned maintenance with significant effects in advance.

8. Privacy

We process personal data under applicable privacy law, including the GDPR. Accepting these terms is not consent to marketing, tracking or other processing requiring separate consent.

How we process personal data, which providers we use and how long we retain data is described in our separate privacy notice at https://wizardsclub.raymondwensveen.nl/en/privacy/. For personal-data questions and requests for access, correction, erasure or portability, email raymond@dockyard.app. We handle requests within statutory time limits. You can complain to the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

9. Software rights and external services

We or our licensors retain rights to the software, design and our own texts. During the agreement you receive a non-exclusive right to use the service as intended. Statutory usage rights and rights under applicable open-source licences are not restricted.

Wizards’ Club is an independent product, not affiliated with or endorsed by Wizards of the Coast. Third-party trademarks and other rights remain with their owners. Card information is supplied by Scryfall where indicated. External services have their own terms for those services; this does not remove our own statutory responsibility.

10. Ending the agreement and misuse

You can end your free account agreement at any time without charge by emailing raymond@dockyard.app. There is no notice period for the free account. We may only ask for information reasonably needed to verify that the request is yours. Logging out or removing the app does not itself close your account.

For a serious breach, we may restrict access or terminate the agreement where necessary and proportionate. We normally explain the problem first and give you a reasonable opportunity to remedy it. We may act immediately in case of an urgent security threat, unlawful use or a legal obligation. We explain the reasons where legally permitted, and you can challenge the decision by email.

If we permanently discontinue the free service, we normally notify you at least 30 days in advance, unless an urgent security reason or legal duty prevents this. We give you a reasonable opportunity to request your data. Upon termination we respect statutory rights to retrieve data and, for paid services, any applicable refunds.

11. Liability and statutory rights

Liability is governed by Dutch statutory rules. These terms do not generally exclude our liability or impose a fixed cap on compensation.

Your statutory rights to performance, remedies, price reduction, termination, compensation and personal-data protection remain intact wherever the law grants them. We also assess our responsibility under the law when a failure originates with a third party.

12. Changes

A new version of these terms applies to new registrations from the stated date. We change terms for an existing agreement only with your consent or another legal basis provided by law. Publication on the website or continued use alone does not automatically constitute consent.

We may make technical improvements and adjustments needed for security, legal duties or maintaining the agreed functionality. For changes beyond this that materially impair your use, we follow statutory information and termination requirements. Where required by law, you receive advance information on a durable medium, such as email. Previously accepted versions remain accessible at their own web addresses.

13. Complaints, governing law and disputes

Email a description of your complaint to raymond@dockyard.app. We aim to respond substantively within 14 days. If we need longer, we explain why and when you can expect a response. This procedure does not limit statutory deadlines or your right to go directly to court.

Dutch law governs this agreement. If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory protection under the law that would otherwise apply. Disputes may be brought before the court competent under the law; we do not impose exclusive Dutch jurisdiction on foreign consumers.

If a provision is invalid or voidable, the remaining provisions continue to apply insofar as legally possible. The Dutch and English texts describe the same agreement. Translation differences are interpreted consistently with statutory consumer protection and do not limit your rights.
